Congress banned the possession of a substance (marijuana, in this case) and cited the interstate commerce clause of the Constitution as the source of their authority to do so.

However, when Congress couldn't and didn't do the same in 1919 when they banned the manufacturing, sale, and transport of alcohol. They did that via a Constitutional amendment, the only legal way for them to ban a substance. ( Edited by c3rbutt)
